In short

Kivun is a digital calendar and planner for Chabad emissaries. It is used through a yearly subscription bought inside the app, on the App Store or on Google Play. The subscription renews automatically, and you can cancel it at any time through the store. Your information is kept on your own device.

One thing worth reading to the end: the times and dates the app shows are a planning aid, not a halachic ruling. The "Times and dates" section below explains exactly why.

Using the app means you agree to these terms.

Who provides the service

What the subscription includes

• A full Hebrew year, with holidays, new months, fasts and Chabad dates
• The entry and exit times for your location: candle lighting, the end of Shabbat and the end of a fast
• Five planning pages: yearly, monthly, event, fundraising and review
• Daily tasks and local reminders
• Scheduling items from the planning pages into the calendar
• Adding the whole year to the device's calendar, and exporting the calendar to a file
• Backup and restore of your data to a file

After the initial setup, everything works without an internet connection.

Price, period and renewal

The subscription is yearly, and in Israel it costs 99.90 ILS per year. In other countries the price is shown in the local currency in the store. The binding price is the one shown on the store's confirmation screen, before you are charged.

• The charge is made through your store account, an Apple ID or a Google account, and not through us.
• The subscription renews automatically for another year at the end of each period, unless it is cancelled at least 24 hours before the renewal date. The renewal charge is made within the 24 hours before the period ends.
• If the price changes, the store gives notice in advance and follows its own rules. An existing subscription is not changed without such a notice.

The free week

Anyone opening a subscription for the first time gets seven days free. At the end of the seven days the charge is made automatically, unless the subscription was cancelled before then. You can cancel at any point during the week, and then nothing is charged.

What the free week does not include: exporting the whole year to a calendar, meaning adding the year to the device's calendar and exporting the calendar to a file. Both of those arrive with the full subscription. Everything else, including the calendar, the times, the planning, the tasks, the reminders and the backup, is fully open during the free week.

The free week is offered once per store account, under Apple's and Google's own rules. If that account has subscribed before, billing starts immediately.

Cancelling

Cancellation is done in the store the subscription was bought from, not in the app:

• iPhone: Settings, then your name at the top, then "Subscriptions"
• Android: the Google Play app, your profile picture, then "Payments and subscriptions", then "Subscriptions"

Cancelling stops the next renewal. The subscription keeps working until the end of the period already paid for.

We cannot cancel or refund on your behalf. The purchase was made with Apple or with Google, so cancellation and refund requests are submitted to them and decided under their rules. Deleting the app from the device does not cancel the subscription.

What happens when the subscription ends

The app locks, and your information stays on the device. The backup button is available on the lock screen too, so you can always take your data out to a file. Renewing brings everything back exactly as it was.

Times and dates: a planning aid, not a halachic ruling

The times the app shows, including candle lighting, the end of Shabbat, the end of a fast and the daily zmanim, are calculated on the device from the location you entered, using accepted calculation methods. They may differ from your community's own calendar and from local custom.

The calculation depends on several things outside our control: how precise the chosen location is, the device's clock and time zone, and, in Israel, the number of minutes before sunset that the local custom lights, which varies by city and can be changed in the settings.

For a practical question, rely on your local calendar and on your own rav, not on the app. The Chabad dates, the weekly portions and the holidays shown in the app are likewise information for planning. The app issues no halachic ruling and is no substitute for asking a rav.

We correct inaccuracies when they come to light, and it is not possible to undertake that the information will be accurate in every place and every situation.

Your information

What you enter in the app is stored on the device. There is no account, no password and no server it is sent to. The full detail is in the privacy policy, which forms part of these terms.

The content you wrote is yours. Keeping a copy is your responsibility: the app provides a button that backs up to a file, and deleting the app from the device deletes the information it stores. We hold no copy to restore from.

Fair use

• The subscription is personal, for the person who bought it and for their own devices. It may not be transferred, sold or shared.
• Do not attempt to circumvent the subscription mechanism.
• The app, its code, its texts and its design belong to Doneiteasy. The subscription grants a personal licence to use it, not ownership.
• The app may be used for any lawful purpose. Use that breaks the law, or that harms others, is not permitted.

Liability

The app is provided as it is, and we work to keep it functioning properly. It is not possible to undertake that it will always run without fault, on every device and every operating system version.

We are not liable for indirect or consequential damage arising from use of the app or from reliance on information shown in it. In any event, our monetary liability is limited to the amount actually paid for the subscription in the past year.

Nothing in this section limits consumer rights granted by law that cannot be contracted out of.

Apple and Google

This agreement is between you and Doneiteasy. Apple and Google are not parties to it. They operate the store and the payment, and are not responsible for the app, for its content or for its support.

• Support is ours. Apple and Google have no obligation to furnish any maintenance or support services in respect of the app.
• Any claim regarding the app, including a claim that it fails to conform to any applicable legal or regulatory requirement, is directed to us and not to them.
• If a third party claims the app infringes its rights, handling that claim is our responsibility.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. The same applies to Google in respect of a subscription bought on Google Play.
• Use of the app is also subject to the terms of the store it was downloaded from.

Changes to these terms

If these terms change, the date at the top will be updated. A material change, such as a change to what the subscription includes, will also be shown in the app. Continued use after a change means agreement to the updated text.

Governing law

These terms are governed by the laws of Israel.
